Terms and Conditions of Trading
In all following paragraphs, the terms "you" and "your" refers to the customer purchasing an advert on jobs.oursource.co.uk. "We" "us" "our" "ours" refers to OurSource Ltd.
General
In these terms and conditions:
a.'customer' means any person, company, organization or firm which uses this site to purchase services from Caterer.com via us;
b.'Jobseeker' means any person that uses this site to gather information or access the employment vacancies advertised on the site.
c.'Order Form' means an order for Services on a form provided by us (in any format) and signed by a Customer;
d.'Services' means all property products and services made available by us from time to time;
e.'Contract Month' means, in respect of any Order Form relating to the provision of Services for a specified period of months, the calendar month commencing on the start date specified in the Order Form and ending on the day before the same date in the next calendar month.;
f.'Contract Term' means the full term specified in the Order
Terms of use
By using the site and the services available on it you are deemed to accept these terms and conditions and any additional terms and conditions which expressly apply to services and information provided by third parties.
You agree to deal fairly and professionally with individuals who may respond to an advertisement or CV you have posted and not do anything which may bring oursource.co.uk into disrepute.
Use of the site
This section of the site is provided to assist employers seeking to recruit staff and individuals looking for jobs.
Data protection
The use of CVs and other personal information supplied by users of this site is governed by our privacy policy.
Illegal Content
We retain the right to amend or remove the advertisement from the site without liability if we deem the advert to be discriminatory, illegal, misleading or offensive in any way.
Advertisements which appear to discriminate on grounds of sex, race or disability are illegal and may result in proceedings being taken against both the advertiser and the publisher.
If we are required by the Trading Standards, Police or any other similar person or body to disclose information relating to any such advertisement, you authorise the disclosure of such information and acknowledge that we are acting in good faith and you acknowledge that you have no right or cause of action in respect of that disclosure.
Jobseekers
Vacancies
Vacancies advertised on this site or via the Caterer.com affiliate links are provided by prospective employers and their agents and are not reviewed by us.
We accept no responsibility or liability for the contents advertisements and expect jobseekers to carry out such verification and personal security procedures (click through) as are customary and prudent.
If you choose to create a profile and upload a CV to our database, it is your responsibility to ensure that your details are accurately maintained and up to date. Note: your personal information will not be publicly displayed on this site as jobs.oursource.co.uk identifies you to recruiters with an ID number,
When you post your CV on this site, it will be made available for viewing over the Internet and downloading by prospective employers. You should be aware that your current employer may be a user of this site and you could be recognized via your employment record.
We will keep your CV on our site for a period up to a maximum of 12 months.
The accuracy of the information you supply is your responsibility and you agree to indemnify us against any legal claims or other expenses that arise as a result of misleading or inaccurate claims you make.
You warrant that in relation to your CV placed for publication with us;
- All details supplied by you for publishing are fair, honest, accurate and not misleading in any way
- CV content should only include factual information which can be verified by reasonable inspection
Limitation of liability
OurSource Ltd accept no responsibility for any implications associated with your Cv being published on this site.
Employers
Commencement of Services
We will not commence the provision of Services pursuant to any Order Form until the Order Form has been returned to us, in a form approved by us and signed by the Customer.
Vacancies posted on jobs.oursource.co.uk will remain live for 28 days or such shorter time as agreed with the Customer.
Job advertisements placed on jobs.oursource.co.uk must be for genuine vacancies only, and not for other products or services, either relating to or unrelated to recruitment.
Content and links
Although we take every precaution to ensure that all links remain “live” it is your responsibility to check links remain unbroken and notify us should the link not be working effectively. However we will make every effort to ensure link effectiveness at all times. You will indemnify us from and against any claims or liability arising from content or links contained in your advertisements
Adverts
You warrant that in relation to each advertisement placed for publication with us;
- That all details supplied by you for publishing are, to the best of your knowledge, fair, honest, accurate and not misleading in any material way.
- The accuracy of the information you supply is your responsibility and you agree to indemnify us against any legal claims or other expenses that arise as a result of misleading or inaccurate claims you make about the property you are advertising.
- Vacancy advert descriptions should only include factual descriptions and which can be verified by reasonable inspection, or in the case of any legal aspects, confirmed by available documentation.
- The reproduction and/or publication of such advertisement will not breach any contract or infringe or violate any copyright, trademark, or any other personal or proprietary right of any person or render us liable to any proceedings whatsoever;
- The advertisement complies with the requirements of all relevant legislation (including subordinate legislation, the rules of statutory regulatory authorities, and the law of the European Community) for the time being in force in the United Kingdom;
- You are the owner of or you are authorised to release for publication all images, text, logos etc incorporated in the advertisement submitted to us for publication and in the event of any dispute between us and the Copyright owner you warrant that you will hold us indemnified as to the costs of any action for breach of Copyright and any damages following thereon.
- Though we take every precaution to ensure that all advertisements appear correctly it is your responsibility to check advertisements and notify us of any mistake or inaccuracy immediately when it appears. However we will make every effort to ensure accuracy at all times.
- We will not be liable for any loss of original or copy artwork, photographs or other materials howsoever caused. You will provide such materials and warrant that you have retained the same in sufficient quality and quantity for whatever purpose.
Where there is a dispute as to content of the advertisement, our decision is final.
Employment agencies and employment businesses
If you are an employment agency or an employment business (as defined by the Employment Agencies Act 1973 ('the Act')) it is your responsibility to ensure that advertisements you place on jobs.oursource.co.uk comply with your obligations under the Act and Conduct of Employment Agencies and Employment Businesses Regulations 2004.
You agree to comply with the Act and these regulations as they affect the conduct of your business and the advertisements you place on jobs.oursource.co.uk
Responses to advertisements
We do not guarantee any response to your advertisement or that responses will be from individuals suitable for the job advertised. It is your responsibility to carry out such checks and procedures as are necessary to ensure that jobseekers are suitable for the job advertised and have the required qualifications and personal characteristics.
You will indemnify us from and against any claim brought by an individual against OurSource Ltd arising from your breach of this obligation or any other of these terms and conditions.
Termination
The Customer may terminate the provision of Services under any Order Form by no less than 30 days notice to expire at the end of a Contract Month. Termination by the Customer before the end of the Contract Term may, at our discretion, result in loss of discounts agreed for the entire Contract Term.
We may terminate the provision of Services if:
i. the Customer is in material breach of these terms and conditions and has not remedied such breach within ten days of notice specifying the breach and requiring that it be remedied, or:
ii. the Customer becomes insolvent, ceases to trade or goes into liquidation.
Equipment
It is your responsibility to ensure that you have the appropriate equipment and are connected to the appropriate services to enable you to post adverts to jobs.oursource.co.uk
These Conditions shall be interpreted in accordance with and governed by English law.
